can't use every thing, try to avoid making it too inflammatory to turn off
those who need to learn in the center. Also time limits me. If an item comes in
unformatted for the blog, I look to see how much interest it has, plus how much
time to will take to pull it and format it.

Fair Use
For those of you with blogs, I attended a seminar on
copyright with an attorney a while back. She said that some publications have
signed agreements with law firms to troll the net with robot programs to fine
uses of material from the publications, then shake down the web
owner/publisher, and split 50-50 with the publication. Using too much of a
piece from a newspaper cost one of her clients $70,000. Fighting it would have
cost more. She said three sentences (unless they comprised a substantial part
of the piece) would usually keep you within "fair use." Of course,
you could still have to go to court, with lawyer fees, to get a judge to agree.

Excerpt: In the middle of an event to extol the virtues of
the U.S. Constitution and “American Laws For American Courts,” the audience
learned first-hand how easy it is to lose their freedom of Speech and Assembly.
Amid shouts of “What about free speech?” from the audience, the Allegan Police
Department ordered the event shut-down. School officials notified police that
they had received a letter complaining about the event from Dawud Walid, Executive
Director of the Council on American-Islamic Relations (CAIR-MI). (A police
chief shuts down a public speaking event because a Muslim organization objected
to it? First making up specious reasons for doing so, then admitting no real
danger existed to anyone? This is PC taken to infinite insanity level, Free
Speech is one of our super core values, not to be trifled with unless a clear
and present real danger is obvious. Even then, the answer is normally more
security for the speakers, not silencing them and thus giving in to those who
don't believe in Free Speech that they don't like. This is really a sad case,
and I hope the lawsuit brings down a ton of flak on the perpetrators. --Del )

executive order: end runs the Constitution and undermines confidence in government
In some detail, Jim Powell surveys the history of
presidential executive orders (http://www.forbes.com/sites/jimpowell/2012/04/29/obamas-plan-to-seize-control-of-our-economy-and-our-lives/).
Some of them are seen to have been beneficial, e.g., the Emancipation
Proclamation. Others are viewed benignly as a president's need to do a good
thing in the face of congressional resistance or inaction. Others are seen as
acts of good intention that, when shown to have failed, were not rescinded
(many New Deal executive orders and Nixon's price controls, properly enacted
laws that executive orders caused not to be enforced, and especially many
military actions not authorized or approved by Congress, etc.). More often than
not, executive actions have been an act of expedience by fiat by the president
simply to do his will. Obama has issued Exec. Order 13603 that authorizes
dictatorial power to essentially take over the economy. Powell voices fear that
Obama could declare an emergency in order to activate this order and might do
so in an electoral ploy.(Powell reports that the state of emergency declared in
1933 was not lifted until 1974.) Could it be that congressional gridlock exists
because over 13,000 executive orders obviates the very idea of consultation and
compromise? Has Congress in effect resigned itself to posture more as a
debating society rather than a legislative body? My partisanship with respect
to Executive Order 13603, the appointment of czars and capricious findings by
cabinet departments that use the police power to drive politically motivated
goals is evident. However, we should all be alarmed: government by decree is precisely
what our Constitution was designed to avoid. Polls show 90% hold Congress in
disdain. If the people were to be fully aware of the extent to which we are
ruled by decree, the institution of the presidency would lose a much respect
and a big chunk of its legitimacy. If our society is to function with a high
degree of civility and consensus, this is not the way to operate. This may seem
a nerdy campaign issue given the big issues of economic performance, debt and
entitlement. If congressional earmarks was a subject for debate, I believe
government by executive order ought to be raised. The candidates should be made
to explain how they will govern. We, the citizens, should consider how we will

(This is an interesting look at a bit of American history I’d never heard

because she's part Cherokee. It turns out Warren has a tiny fraction of Native
American blood, according to a genealogist, but being 1/32nd Cherokee is
probably not enough to identify herself as a minority to the Association of
American Law Schools, where she is listed as a minority professor from 1986 to
1995. (I wonder if purchasing a feathered headdress would be considered a
campaign contribution if it was only worn to opposition events to remind them
of how liberals twist the rules? By itself, this probably won't change many
minds (and none at all among liberals). The real question ought to be if she
cheated on this, what else has she cheated on? Between the number of registered
Democrats, the out-of-state money being spent, the voter's general acceptance
of the liberal line, the ACORN-like groups and their organized cheating at the
